Twitter and Facebook Survey Contest Official Rules 2019
1. GENERAL
The Twitter and Facebook Survey Contest (the “Contest”) begins Thursday, September 19, 2019 at 12:00:00 a.m. Eastern Daylight Time (EDT) and ends Friday, October 18, 2019 at 11:59:59 a.m. EDT (the “Contest Period”). Winner will be announced on Friday, October 25th, 2019.
The Contest is run by Action Against Hunger Canada, 500-720 Bathurst Street, Toronto, ON M5S 2R4 (the “Sponsor”). This Contest is in no way sponsored by, endorsed by, https://actionagainsthunger.ca/cms/wp-content/uploads/2013/08/otp50-1.jpgistered by, or associated with, Facebook, Twitter or Instagram. For the purposes of the Contest, the “Contest Group” is composed of the Sponsor, together with each of their respective affiliates and related companies, including without limitation their parent, sister and subsidiary organizations, advertising and promotion agencies, suppliers of material and services related to the Contest, and any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Contest and their respective officers, directors, employees, agents, and other representatives.
2. ELIGIBILITY
The Contest is open to individuals who are: (a) legal residents of Canada (excluding residents of the Province of Quebec); and (b) over the age of majority of his/her province or territory of residences; and (c) located within Canada (excluding the Province of Quebec) at the time of entry. Selected winners will be required to provide proof of age and residency, and parental/guardian consent, if applicable; and (d) have a valid email address (the “Entrant”).
Employees, families or affiliates (or those with whom they are domiciled) of the Sponsor are not eligible to enter this contest. Entrants must correctly answer, unaided, the skill testing question on the Declaration and Release form to be eligible for the prize.
By submitting an entry to the Survey Contest, Entrants certify that their participation in this Contest is not illegal or in violation of any law, regulation treaty or https://actionagainsthunger.ca/cms/wp-content/uploads/2013/08/otp50-1.jpgistrative act, and that the laws of their governing jurisdiction of residence at the time of entry do not prohibit or restrict the receipt of the prize under this Contest.
3. WHAT TO ENTER
Action Against Hunger Canada is committed to fighting malnutrition and its root causes worldwide. For our Twitter and Facebook Survey Contest, we would like to know: What inspires you to take action against hunger? Everyone has different reasons why they want to make the world a better place!
Answer a short Facebook/Twitter Survey so we can learn more about what issues/topics that interest you.
4. HOW TO ENTER
There are two methods to enter as listed below. No purchase or payment is necessary to enter or win. A purchase or payment will not affect the Entrant’s odds of winning.
Entries submitted before September 19, 2019 at 12:00 a.m. or after October 18, 2019 at 11:59:59 p.m. (the”Entry Period”) will not be eligible.
4.1 TO ENTER CONTEST WITH A FACEBOOK and TWITTER SURVEY SUBMISSION.
To enter the Contest by answering our survey on Facebook/Twitter, the Entrant must:
(a) Answer the Facebook Survey or Twitter Survey hosted by the Sponsor’s Facebook account (https://www.facebook.com/acfcanada/) or Sponsor’s Twitter account (https://twitter.com/acfcanada)
(b) the survey must be completed to be eligible for the contest (see point 3. What to enter);
(c) the Entrant must enter a valid email address.
(d) Upon entering your email address, you agree to receive weekly emails from Action Against Hunger. You can opt out anytime.
The completion of the above criteria on one (1) or more social media platforms (Facebook, and/or Twitter) will qualify as one (1) entry. Entrants may participate in answering the same survey on a different social media platform. Submitting the Entry to more than one (1) social media platform during the Entry Period does not qualify as an additional entry, nor does it affect the Entrant’s chances of being shortlisted (see point 5. How to win).
To participate in the Contest, the Entrant must have a valid Facebook/Twitter account that is in good standing. If the Entrant does not have a Facebook/Twitter account, visit www.facebook.com / www.twitter.com and register in accordance with the enrollment instructions for a free Facebook/Twitter account. The terms and conditions for creating and maintaining a Facebook/Twitter account are at the sole discretion of Facebook/Twitter. The Contest is open to existing Facebook/Twitter account holders as well as new account holders.
If the identity of an Entrant is disputed, the authorized account holder of the email address submitted at the time of entry will be deemed to be the Entrant. The individual assigned to the email address for the domain associated with the submitted email address is considered the authorized account holder. A selected Entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry. All entries must be submitted from a valid email account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).
5. HOW TO WIN
The contest comprises two selection phases:
(1) All entries collected during the Entry Period will be examined by a jury of experts as selected by the Sponsor. On Friday, October 18, 2019, the jury of experts will bee at 500-720 Bathurst Street in Toronto, Ontario, to randomly select the entrants from the Facebook/Twitter Survey Contest.
(2) The winner will be notified through the email submitted in the survey and on the platform of their submission: Action Against Hunger Canada’s official Facebook page (facebook.com/acfcanada/) or Action Against Hunger Canada’s official Twitter page (twitter.com/acfcanada) by Friday, October 25, 2019, before 11:59:59 p.m. EDT
Survey response generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be subject to disqualification in the sole and absolute discretion of the Sponsor. The Sponsor will not be responsible for any late, lost, illegible, falsified, damaged, misdirected, mutilated, garbled or incomplete survey responses, which will be void. All survey responses become the property of the Sponsor upon receipt and are subject to verification. Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity (in a form acceptable to the Sponsor) from any entrants to participate in this Contest or for any responses entered, or purportedly entered, by such entrant to be considered valid for the purposes of this Contest. Failure to provide such proof in a timely manner may result in disqualification of the applicable entrant that cannot be verified to the satisfaction of the Sponsor, in its sole and absolute discretion. The sole determinant of time for the purposes of a valid survey responses in this Contest will be the Contest server machines.
Entrants associated with Facebook or Twitter survey may encourage friends and other eligible individuals to cast their entry; however, they may not offer any individual any form of incentive, inducement, prize or chance of receiving any incentive or inducement (including vote exchanging), or prize in furtherance of receiving such individual’s response for any entry. If any individual is determined by Sponsor, in its sole and absolute discretion, to be associated with, engaging in, benefiting from, soliciting, encouraging, and/or participating in any unfair and/or fraudulent voting practices, such entry and/or submitted votes, as applicable, will be subject to disqualification, at the sole and absolute discretion of the Sponsor.
The Sponsor will randomly select the Entry that was received during the contest period and will be eligible to win the prize (“Selected Entrant”) on Wednesday, October 16, 2019 at 11:59:59 a.m. EDT.
All decisions are final.
The Sponsor will notify the winner via the contact information provided at the time of entry.
Odds of being selected as eligible to win a prize depends on the total number of eligible Entries received during the Entry Period, the ability of a submission to satisfy the survey response criteria outlined above at the sole discretion of the jury of experts.
6. PRIZE CLAIM CONDITIONS
The Selected Entrant will be notified by direct message to the applicable social media account and/or email address submitted within forty-eight (48) hours of the winner determination. The Selected Entrant will also be announced by the Sponsor via social media, including but limited to their accounts on Facebook, Twitter and Instagram. If the Selected Entrant submitted the winning entry via email, the Selected Entrant will be notified by the email address used to submit the winning entry within forty-eight (48) hours of the winner determination.
In order to be declared a winner, Selected Entrant must: (i) respond to notification of selection within three (3) business days of first attempt by Sponsor; (ii) correctly answer a mathematical skill testing question on a written Declaration and Release form; (iii) sign and return to Sponsor within the stated time period a written Declaration and Release form, releasing the Contest Group from any liability in connection with this Contest or the use or misuse or possession of any prize (the “Release”); and, (iv) otherwise comply with these Official Contest Rules.
Upon satisfaction of the above requirements, the prize will be delivered to the winner via mail. Return of any prize or winner notification as undeliverable, inability to reach Selected Entrant, failure of Selected Entrant to respond to notification by the deadline, failure to provide proof of eligibility (if requested), the Release, or other required documentation in a timely manner, failure to correctly answer the skill-testing question, or other non-compliance with these Official Contest Rules may result in disqualification, forfeiture of the prize and, at Sponsor’s sole discretion, selection of an alternate Selected Entrant for the forfeited prize in accordance with these Official Contest Rules, who will be subject to disqualification in the same manner.
7. PRIZE
There is (2) prize (“Contest Prize”) available to be won, consisting of (2) Visa Prepaid Card valued at $50 each.
Prize must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise. Sponsor reserves the right, at their sole discretion, to substitute a prize of greater or equivalent monetary value if a prize cannot be awarded as described for any reason. Sponsor will not replace any lost or stolen prizes. Any other taxes, costs or expenses associated with the prizes not specified herein will be the responsibility of selected winner.
8. YOUR RIGHTS
Your survey response helps Action Against Hunger Canada further understand their audience thus tailoring their message and its mission to eradicating hunger in the world. Thank you for helping to further our mission through your responses. If you submit a survey to enter the Contest, you grant Action Against Hunger a royalty free, nonexclusive right to:
- Use the survey information to tailor information sent out to viewers/subscribers.
- Opt into our weekly newsletter but allow subscribers to opt-out at any time.
9. RIGHT TO VOID / TERMINATE / SUSPEND / MODIFY
Sponsor reserves the right to terminate, suspend or modify this Contest, in whole or in part, at any time and without notice or obligation if, in Sponsor’s sole discretion, any factor interferes with its proper conduct as contemplated by these Official Contest Rules. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole discretion of Sponsor, corrupt or affect the https://actionagainsthunger.ca/cms/wp-content/uploads/2013/08/otp50-1.jpgistration, security, fairness, integrity or proper conduct of this Contest, or for any other reasons at the sole discretion of the Sponsor, Sponsor may, in their sole discretion, void any suspect entries and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to address the impairment and then resume the Contest, or relevant portion, in a manner that best conforms to the spirit of these Official Contest Rules; and/or (c) award the prizes from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria discussed above.
10. GENERAL CONDITIONS
Winning a prize is contingent on fulfilling all the requirements set forth herein. Decisions of Sponsor and/or any independent contest judging organization will be final and binding on all matters pertaining to this Contest. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. Sponsor’s failure to enforce any term of these Official Contest Rules shall not constitute a waiver of that pro-vision. The invalidity or unenforceability of any provision of these Official Contest Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Contest Rules is determined to be invalid or otherwise unenforceable, then the Official Contest Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Sponsor reserves the right at its sole discretion to disqualify any entrant who tampers or attempts to tamper with the entry process, the operation of the Contest and/or Contest Website, violates the Official Contest Rules, or acts with intent to annoy, abuse, threaten or harass any other person.
WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
11. LIMITATIONS OF LIABILITY AND RELEASES
BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT THE CONTEST GROUP HAS NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM A PRIZE, INCLUDING THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE, OR THE MERCHANDISE FOR WHICH IT IS REDEEMED. FURTHER BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT CONTEST GROUP HAS NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) ENTRY OR PARTICIPATION IN THIS CONTEST, INCLUDING ACCESS TO AND USE OF THE CONTEST WEBSITE, OR B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR MERCHANDISE DELIVERY.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages; therefore such exclusions may not apply to you.
Without limiting the foregoing, the Contest Group shall not be responsible for: (a) any incomplete or inaccurate information that is caused by Website users, or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; the theft, destruction, loss or unauthorized access to, or alteration of, entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any e-mail to be received by or from the Contest judging organization or Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user’s computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Contest; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or technical, pictorial, typographical or editorial errors or omissions contained herein.
